Imran Khan has spent the past few weeks in headlines over his appearance at a CJP protest in Mumbai. On Monday, the matter reached the Bombay High Court, and the actor walked out with interim relief: the FRRO notice asking him to leave India is on hold until his next hearing on December 7.
The “Leave India” notice is tied to his American citizenship. Khan is a US citizen who holds an Overseas Citizen of India (OCI) card – a status that lets him stay and work in India but, as the court made clear, does not carry the full rights of a citizen.
What the bench said
The court was direct. “You are an OCI card holder. You can’t behave like an Indian citizen,” the bench told the Mere Brother Ki Dulhan actor, adding that he had “nothing to say about SIR” – the Special Intensive Revision of electoral rolls – and “no right to participate” in the protest.
Khan submitted an unconditional apology. In his undertaking, he assured the court: “I shall not participate in any protest in the future, nor shall I directly or indirectly influence or instigate others to participate in any such protest.” He also expressed his “utmost love and respect for this great nation and its Constitution.”
What this means for OCI cardholders
The exchange puts a firm boundary on record. OCI status opens the door to India: multiple entry, long stays, and work rights. But the court’s reading is clear – political demonstrations are an Indian citizen’s act, and an OCI card does not grant the right to join them.
Here is the sequence that led to the relief:
- Khan joined a CJP protest in Mumbai and drew attention over several weeks
- The FRRO issued a “Leave India” notice tied to his US citizenship
- He challenged the notice in the Bombay High Court
- After a reprimand from the bench, he apologised and gave a categorical undertaking
- The notice is on hold until the next hearing on December 7
What happens next
Until December, Khan can remain in India. The bench kept the notice on hold after accepting his promise to stay away from protests entirely – not just this one. The undertaking he gave may now become the standard expected in similar cases involving OCI cardholders.
For fans, the case is a reminder that the industry’s international stars often hold different legal statuses, and those statuses come with lines that even a well-known face cannot cross.
